Welcome to HaveTheWhy. These Terms of Service ("Terms") are an agreement between you and HaveTheWhy ("we", "us", "our"). They govern your use of the HaveTheWhy website at havethewhy.com, the application at app.havethewhy.com, and the services we provide through them (together, the "Service").
By creating an account or using the Service, you agree to these Terms. If you don't agree, please don't use the Service.
1. Who can use HaveTheWhy
- You must be at least 18 years old to create an account.
- The Service is built for business and professional use — running user research, customer interviews, and similar work.
- If you use the Service on behalf of a company or other organization, you confirm that you have the authority to accept these Terms for that organization, and "you" means both you and the organization.
2. What the Service does
HaveTheWhy is a self-serve platform for AI-led interviews. You describe a research goal, the platform creates an AI interviewer for you, and you share a single invitation link. People who follow that link ("Respondents") talk to your AI interviewer over web chat or messaging channels such as WhatsApp and Telegram. The platform then turns those conversations into a Snapshot analysis and gives you access to the raw transcripts.
The Service is currently in beta — see Section 3.
3. Beta terms
While the Service is in beta:
- The current offer includes 5,000 free credits for new accounts. Credits are a usage allowance only — they have no monetary value, cannot be redeemed for cash, and are non-transferable.
- Features may change, be added, or be removed as we develop the product.
- We do our best to keep the Service running, but availability is not guaranteed during beta.
- We may introduce paid plans or change how credits work in the future. If we do, we will give you reasonable advance notice before anything starts costing money.
4. Your account
You sign in to HaveTheWhy through our identity provider, Auth0, using email and password or by continuing with your Google or Microsoft account. You agree to:
- provide accurate account information and keep it up to date;
- keep your login credentials secure and not share your account;
- tell us promptly if you suspect unauthorized access to your account.
You are responsible for activity that happens under your account.
5. Your content and your responsibilities
You own your research content and your interview data ("Customer Content"). This includes your research goals and interviewer setup, files and links you add to your knowledge base, the messages your Respondents send, the transcripts, and the Snapshot analyses generated for you.
Because you decide who to invite and what your AI interviewer asks, you are responsible for:
- having a lawful basis — including consent where required — to collect and use your Respondents' data, under the laws that apply to you and to your audience;
- the questions your interviewer asks and the instructions you give it;
- not soliciting sensitive personal data (such as health information, financial account details, government ID numbers, or data about children) unless you have a clear legal justification for collecting it;
- only inviting people you are allowed to contact, and complying with anti-spam and messaging laws in your Respondents' jurisdictions.
Where Respondent data is personal data under laws like the GDPR, you are the controller and we process it on your behalf, only to provide the Service and on your documented instructions. If you need a data processing agreement, email us at supporthavethewhy [dot] com and we will put one in place.
6. Respondents
If you are a Respondent — someone invited to talk to an AI interviewer:
- Participation is voluntary. You can stop the conversation at any point.
- You are talking to an AI interviewer. Customers must not configure it to claim it is a human.
- The customer who invited you runs the research; we process your conversation on their behalf. Our Privacy Policy explains how your data is handled and how to reach us.
7. Licenses
Your license to us. You grant us a limited, non-exclusive license to host, store, process, and transmit your Customer Content — solely to provide, secure, support, and maintain the Service, including diagnosing and fixing problems. We don't sell or share your Customer Content (beyond the service providers needed to run the Service), and neither we nor the AI providers that power the Service use it to train models.
Your outputs. You own the outputs the Service generates for you — Snapshots, analyses, and transcripts — and may use them freely in your own work.
8. Acceptable use
You agree not to:
- use the Service for anything unlawful, harassing, deceptive, or harmful;
- send spam or unsolicited mass messages through the interview channels, or use the Service to contact people who haven't agreed to participate;
- misrepresent who is running the research or pass the AI interviewer off as a human;
- upload malware or content that infringes someone else's rights;
- reverse engineer, scrape, or copy the Service, or resell access to it without our written agreement;
- attempt to extract the underlying models or prompts, bypass usage limits or the credit system, or probe or disrupt the Service's security.
9. AI-generated output
Snapshots, analyses, and interviewer responses are generated by AI. They can contain errors, omissions, or misinterpretations, and the same input may produce different results at different times. Outputs are research material, not professional advice — legal, medical, financial, or otherwise. Review and validate outputs before relying on them for significant decisions.
10. Third-party services
The Service works together with services we don't control, and your use of them is governed by their own terms:
- messaging channels such as WhatsApp (operated by Meta) and Telegram;
- sign-in via Auth0, and Google or Microsoft if you use their login;
- the third-party AI providers whose models power interviews and analysis.
We are not responsible for these platforms, and the availability of a particular channel may change if a provider changes its service or policies.
11. Privacy
How we collect, use, and protect personal data — for both account holders and Respondents — is described in our Privacy Policy. It is part of how we run the Service, so please read it.
12. Feedback
If you send us ideas, suggestions, or feedback about the Service, we may use them without restriction or obligation to you. This helps us make the product better, especially during beta.
13. Our intellectual property
HaveTheWhy owns the Service — the platform, software, design, and branding. These Terms give you the right to use the Service; they don't transfer any ownership in it to you. Please don't use our name or branding without our permission.
14. Disclaimers
The Service is provided "as is" and "as available", without warranties of any kind, express or implied — including fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. This matters especially during beta, when things change quickly. Some jurisdictions don't allow certain warranty exclusions, so parts of this section may not apply to you.
15. Limitation of liability
To the fullest extent permitted by law:
- neither party is liable for indirect, incidental, special, or consequential damages, or for lost profits, revenue, or data;
- our total liability arising out of the Service is capped at the greater of the amount you paid us for the Service in the 12 months before the event giving rise to the claim, or USD 100.
Nothing in these Terms limits liability that cannot be limited by law.
16. Indemnity
You agree to cover us against third-party claims that arise from your Customer Content, your misuse of the Service, or your failure to obtain required consents from your Respondents. We'll notify you promptly of any such claim and reasonably cooperate with you.
17. Suspension and termination
- By you. You can stop using the Service at any time. To close your account, email us at supporthavethewhy [dot] com.
- By us. We may suspend or terminate your access if you materially breach these Terms, misuse the Service, or create legal or security risk. Where reasonable, we'll notify you and give you a chance to fix the issue first.
Your data on the way out. You can export your interview data from the dashboard as CSV or JSON. You can delete respondents and research data from the dashboard, which also removes the underlying technical records. If you want your account and its data deleted, email us at supporthavethewhy [dot] com and we will handle the deletion.
Sections that by their nature should survive termination (such as your ownership of outputs already delivered to you, disclaimers, limitation of liability, and indemnity) survive.
18. Changes to these Terms
We may update these Terms as the Service evolves. When we make material changes, we'll give you reasonable notice — for example by email or a notice in the app — and update the effective date at the top of this page. Continuing to use the Service after changes take effect means you accept the updated Terms.
If any part of these Terms turns out to be unenforceable, the rest stays in effect.
